Satellite Event. Roundtable Session: Is legal Education in Line with the Demands of Corporate Legal Departments and Law Firms

Russian universities provide their students with a solid academic foundation, but for a successful career, future graduates will also require highly practical and soft skills: time management, emotional intelligence, and the ability to work in a team. Without these, not only do graduates lose out, so too do companies, who are forced to spend time and resources training new employees. The same situation is also apparent in the legal world. Some universities are organising short-term internships for their students in law firms and corporate legal departments, as well as master classes led by practitioners, but employers are not always eager to participate in such initiatives. Why is this the case, and how can legal employers and higher education institutions in the sector find a common language? How can legal education be made practical, and the lawyers of the future prepared for adult working life during their time as students? As part of this dialogue between employers and educators, we will examine case studies of successful collaboration and bold new ideas.

"The Russian LCIA?" - Looking at the Initial Results of the Arbitration Courts Reform

The first arbitration courts established in Russia under the new legislation received accreditation from the Ministry of Justice and may now begin hearings. Further, as of November 2017, arbitration courts that have business entities among their founders will no longer have the right to consider disputes. Given that reputable arbitration centres, such as the LCIA, ICC, SCC and so on have taken decades to establish, how long will it take for the new arbitration centres in Russia to gain recognition? What requirements must the modern arbitration court meet in order for it to become entrusted with the fate of multibillion-dollar contracts? What problems might the new institutions have to deal with? Intellectual Property Rights Disputes: Trends and Case Studies

The Court of Intellectual Property Rights was set up four years ago, as demand for specialized IP protection increased. What has changed over since then? Undoubtedly, the work of this Court has contributed to improvements in the complex field of IP regulation in Russia. However, a number of key problems lingers. This includes problems such as the determination of the fair amount of compensation for violation of IP rights. Patent disputes are often characterized by the procedural needs to appoint experts. In fact, unlike specialized courts in some jurisdictions, the panel of the Court of IP Rights SIP consists of lawyers, who generally do not have additional non-humanitarian degrees. Protection of copyrights needs to effectively deal with online violations and the accountability of information sources and information intermediaries.

Managing a Team of Lawyers

Good lawyers are intellectuals, who know what they want from life in general and from employers in particular. They prefer to align working conditions with their life, rather than vice versa, but are still ready to work “from dawn til dusk”, for the right remuneration package. What should it be? High salaries or non-material perks? Heads of legal departments and law firms are increasingly faced with the fact that non-material motivation is efficient: making the world a better place and pro bono work, open door policy, a well-developed corporate culture, investment in education and so forth. But business is still business: financial KPIs are still on the table and there is a limit to administrative budgets. Well-known in-house lawyers, law firm managing partners, headhunters and HR consultants discuss how to get lawyers to perform super-feats and remain loyal through a skillful combination of sticks and carrots.

Legislative Regulation of the Digital Economy. Blockchain. Internet of Things (Part 1)

The five most valuable companies in the world are all in the tech sector. It is said that “data is the new oil”. Russia intends to invest RUR 100 billion a year under a federal target program to develop the tech sector, whilst the total value of the “leap into the digital future” in Russia is estimated to yield to circa RUR 185 trillion over the next seven years.  Digital market regulation is a fairly novel area that often requires a new approach to legislation. Various bills on internet aggregators, VPN, big data, etc. often draw criticism from the market players. Other bills, for example on drones, are welcomed, but their passing is postponed. What regulation is required in the digital sphere, and how does one strike a balance between government, private and public interests?

Challenges in the Management of International Disputes

A complex international dispute can easily go on for 3 - 5 years or longer. Respective counsel bills often amount to millions of dollars, whilst for the CIS clients, the process often seems less transparent than proceedings in national courts, with the outcome hard to predict. To a large extent, success depends on the work done by local counsel: obtaining expert opinions, working with evidence, and so forth. How to win in international proceedings? How should the dispute be managed? What are the relevant particularities of the courts of various countries? How to choose the right consultant?

Moderator: Evgeny Raschevsky, Partner, Head of International Arbitration and Litigation Practice, Egorov Puginsky Afanasiev & Partners.

Compliance Program as an International Risk Management Tool

Doing business abroad, working with leading global companies and obtaining financing from international banks requires companies from the CIS region to strictly adhere to the ethical standards under international law, exercise strong control over counterparties and investment projects, implement programs to counter financial crime and prevent money laundering. Compliance has become the personal responsibility of the company’s management, as the regulatory requirements of the key markets compelled them to make sure companies are operating legitimately by way of implementing secure control systems. To reduce risks and ensure sustainable business development, a growing number of companies give trainings and implement compliance procedures. New compliance standard ISO 19600:2014 opens up opportunities for company certification, aiming to increase the level of trust of foreign counterparties and institutions. Do such instruments help to mitigate risks perceived by the foreign counterparties? How to become ‘one of them?’ How is the regulatory environment developing in Russia, and what do Russian companies need to do to keep up in the global markets?
